Mr. Wachtel has a comprehensive understanding of a broad range of sophisticated bankruptcy issues generally involving secured and unsecured creditors as well as third party adversary proceeding defendants. Mr. Wachtel has appeared before bankruptcy courts in the Northern (Bay Area, Eastern, (Central Valley and Sacramento), and Central District (Los Angeles and Orange Counties) in connection with virtually all issues that arise in Chapter 7, 11 and 13 bankruptcy cases such as: motions for relief from stay, motions to compel debtors to assume or reject executory contracts, motions for appointment of a trustee, motions to dismiss or convert, adversary proceedings for non-dischargeability, preference avoidance litigation and proceedings related to approval of disclosures statements of confirmation of plans.
Mr. Wachtel does not generally represent debtors in bankruptcy but frequently consults on insolvency planning issues in which the pros, cons and ramifications of Bankruptcy as well as other alternatives can be freely discussed. Mr. Wachtel can draw on his over 34 years of litigation, real estate, and general civil litigation experience in these bankruptcy related issues. |
